Heather H. Whitehead — Attorney

Heather H. Whitehead is an attorney with Berding|Weil in the corporate and business law department. She has practiced real estate law over 15 years with extensive experience in the drafting of CC&Rs and other project governance documents, and the establishment of HOAs and community associations, including compliance with the Department of Real Estate, financing and other requirements. Ms. Whitehead provides general counsel services to community associations concerning day-to-day operations, community governance, elections, rules, policy adoptions, insurance, construction and various real property issues. She also specializes in amendments and restatements of CC&R's and other association governing documents, having a unique understanding of underlying considerations related to these documents.

Professional History

Prior to joining Berding|Weil, Ms. Whitehead's practice focused on developing practical strategies for addressing business risks facing the real estate and construction industries.  This included the negotiating and drafting of contract documents, construction and real estate agreements as well as providing guidance on insurance programs and other risk management strategies and working in various matters encompassing commercial, retail, industrial, mixed-use, multi-family and residential projects, including common interest developments.

Most recently, Ms. Whitehead worked as in-house legal counsel specializing in HOA and community relations, as well as advising on corporate governance, construction, risk management and compliance considerations.


Ms. Whitehead received her Juris Doctorate from Loyola Law School, Los Angeles in 2005. Prior to law school, she obtained a Master of Business Administration from Pepperdine University in 2001. Ms. Whitehead received her Bachelor of Science in Business Administration, graduating early, from the University of Southern California in 1997.
